1. Introduction

Welcome to Inheribase ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Inheribase protocol, including our website, MCP server, smart contracts, and related services (collectively, the "Service").

By minting a Sovereign Identity, purchasing Gas Credits, or connecting an AI Agent, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description: Infrastructure for Sovereignty

Inheribase provides decentralized infrastructure for digital legacy and autonomous agent memory. The Service enables you to:

Create encrypted "Vaults" containing data, keys, or media.
Anchor encrypted data permanently on the Arweave network.
Program automated release conditions ("Dead Man's Switch") via smart contracts.
Connect AI Agents via MCP (Model Context Protocol) to read/write to your vault.

Important: Use of the Service involves interaction with public blockchains (Base, Arweave). We do not control these networks and cannot reverse transactions.

3. Eligibility & Protocol Access

You must be at least 18 years of age (or the age of digital consent in your jurisdiction) to us the Service. By connecting a wallet or agent, you represent that:

You have the legal capacity to enter into these Terms.
You are not located in a jurisdiction where using decentralized storage is prohibited.
You provide accurate authentication data (wallet signature or social login).

4. Payment: The Gas Tank Model

Inheribase operates on a "Prepaid Gas" model, not a subscription.

4.1 Verification & Anchorage Fee

A one-time verification fee may be charged when interacting with the Base network to initialize your on-chain Identity. This fee covers network gas and protocol initialization. This fee is non-refundable, except as expressly provided under the Airlock Technical Guarantee in Section 5.2 below.

4.2 Gas Credits

You purchase "Gas Credits" (e.g., $10, $50 packages) which are stored in your account. Credits are "burned" (deducted) to pay for:

Permanent storage allocation on Arweave (cost per MB).
Smart contract execution (Setting guardians, updating triggers).
MCP Agent API bandwidth.

Note: Unused credits generally do not expire, but we reserve the right to archive inactive accounts after 24 months of total dormancy (no login, no agent activity).

5. Refunds & The Airlock Guarantee

5.1 Verification Fee Refunds

The verification and anchorage fee is NON-REFUNDABLE. This fee covers the Base network gas costs and protocol initialization. Since these funds are paid directly to network validators, we cannot reclaim them. This non-refundable policy does not apply to Gas Credits consumed during a Lock operation that qualifies for the Airlock Technical Guarantee below.

5.2 Airlock Technical Guarantee (God Mode Guarantee)

Inheribase guarantees the reliability of its Arweave anchoring infrastructure. If the protocol fails to return a valid Arweave Transaction Hash (TXID) within 24 hours of a confirmed “Lock” operation, you are entitled to a credit of 10x the Gas Credits consumed by that specific failed operation, applied directly to your Gas Tank balance. This guarantee applies exclusively to protocol-side failures in the Arweave anchoring process and does not cover user errors, third-party network outages beyond Inheribase’s control, or Base network gas costs unrelated to the failed Lock operation.

To claim, submit a support request at support@inheribase.com with the failed operation’s transaction reference. Claims must be submitted within 30 calendar days of the failed Lock operation.

6. User Responsibilities

You agree to:

Secure Your Keys: You are solely responsible for your private keys, seed phrases, and recovery codes. We cannot recover them.
Supervise Agents: You are responsible for all actions taken by AI Agents you authorize via API keys.
Lawful Use: Not use the Service to store illegal content (CSAM), malware, or stolen intellectual property.

7. Content & Intellectual Property

Your Content: You retain full ownership of encrypted data you store. We claim no rights to your vault contents.
Protocol IP: The Inheribase interface, brand, and proprietary API code are owned by Inheribase Inc. Open-source contracts are licensed under Apache 2.0.

8. Blockchain & Decentralization Risks

You acknowledge that the Service relies on experimental technology.

Immutability: Mistakes on the blockchain (e.g., sending funds to the wrong address) are irreversible.
Network Failures: We are not liable for outages on Base, Arweave, or congestion causing gas spikes.
Regulatory Uncertainty: Changes in laws regarding crypto-assets may impact the Service.

9. General Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

We do not guarantee that: (a) the service will be uninterrupted or secure; (b) the Arweave network will persist indefinitely (though built for permanence); or (c) your heirs will successfully retrieve data if they lose their recovery instructions.

10. Limitation of Liability

IN NO EVENT SHALL INHERIBASE INC., ITS DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CRYPTO-ASSETS, OR PRIVATE KEYS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IN GAS CREDITS OR FEES) IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Inheribase Inc. from any claims arising out of: (i) your use of the Service; (ii) your violation of these Terms; (iii) your agents' actions; or (iv) any content you store in your Vault.

12. Termination

We may suspend your access to the web interface or API if you violate these terms.However, your on-chain data and Arweave storage are permanent and censorship-resistant. We cannot "delete" your vault from the blockchain, only block access through our specific gateway.

13. Modifications to Terms

We may modify these Terms at any time. We will provide notice of material changes via the Service. Continued use after changes constitutes acceptance.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware.

Arbitration Agreement: Any dispute shall be resolved via binding arbitration in accordance with the American Arbitration Association rules. You verify that you waive the right to a trial by jury or to participate in a class action.
